1. Acceptance of These Terms

These Terms of Use (the “Terms”) govern your access to and use of the StoryGroup Canada Learning website (the “Site”) and related communications. By using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree, do not use the Site. You must be at least 16 years old to use the Site. If you are under the age of majority in your province or territory, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Who We Are and How to Contact Us

The Site is intended for Canadian organizations and professionals seeking professional development, workplace skills training, leadership development, and continuing learning programs. We may also respond to inquiries from outside Canada, but we do not represent that the Site is appropriate or available for use in all jurisdictions.

3. Educational and Professional Development Disclaimer

The Site provides general information about training programs, learning resources, and professional development approaches. It is not legal advice, financial advice, investment advice, or tax advice. Any examples, checklists, templates, or case-style scenarios are provided for training and illustrative purposes only.

Training outcomes vary. Individual and organizational results depend on baseline practice, leadership support, participation, workplace context, and follow-through. We do not promise or guarantee specific outcomes, performance improvements, promotions, or business results.

4. Description of the Site and Services

The Site describes our training programs and delivery options, including formats such as live virtual cohorts, on-site workshops, and blended reinforcement (for example, job aids and manager coaching cues). The Site also provides a contact form for requesting training options and scoping discussions.

We may update, revise, suspend, or discontinue any part of the Site at any time. We may also add or remove content, including program descriptions, learning objectives, or resource materials, without notice. We aim to keep information current, but we do not guarantee that all content will be accurate, complete, or up to date at all times.

5. Acceptable Use

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site. In particular, you agree not to:

  • Attempt to gain unauthorized access to the Site, servers, or related systems, or to bypass security or access controls.
  • Use the Site to transmit malware, spyware, or other harmful code, or to conduct phishing or credential harvesting.
  • Scrape, crawl, or harvest content or data from the Site at scale, including by automated means, without our written permission.
  • Submit false, misleading, or impersonated information through forms, including pretending to represent an organization you do not represent.
  • Interfere with or disrupt the Site, including through denial-of-service attempts, load testing without permission, or abusive traffic patterns.
  • Use the Site to send spam, unsolicited marketing messages, or mass solicitations.
  • Use the Site in a manner that violates applicable export controls, sanctions, or other trade restrictions.

If we believe your use violates these Terms or creates security risk, we may limit or block your access to the Site without notice.

6. Intellectual Property

The Site and its content—including text, training descriptions, frameworks, learning objectives, templates, visual design, and underlying code—are owned by StoryGroup Canada Learning Inc. or licensed to us, and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business evaluation purposes. You may not copy, reproduce, distribute, publicly display, publish, modify, create derivative works from, or commercially exploit the Site content without our prior written permission.

Any trademarks, service marks, and logos used on the Site are the property of their respective owners. Nothing in these Terms grants you a license to use them.

7. Third-Party Services and Links

The Site may reference third-party services (for example, video conferencing tools, workplace platforms, or learning systems) in a descriptive way. If we link to third-party websites, those links are provided for convenience only. We do not control third-party websites and are not responsible for their content, policies, availability, or practices.

Your use of third-party services is governed by the third party’s terms and privacy practices. You should review those terms before using any third-party service.

8. Submissions and Communications

When you submit information through our contact form or by email, you represent that the information is accurate and that you have the right to provide it. Please do not submit sensitive personal information. For example, do not include government identification numbers or financial account details in messages.

We use submitted information to respond to your inquiry, scope potential training, and provide relevant program options. Our handling of personal information is described in our Privacy Policy.

9. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components. We do not warrant that the information on the Site will always be accurate, complete, or current.

10. Limitation of Liability

To the maximum extent permitted by applicable law, StoryGroup Canada Learning Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption arising out of or related to your use of, or inability to use, the Site.

To the maximum extent permitted by applicable law, our total liability for all claims related to the Site will be limited to the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) CAD $100.

Some provinces or territories may not allow certain limitations of liability. In such cases, these limitations apply to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless StoryGroup Canada Learning Inc., and its directors, officers, employees, and contractors, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Site; (b) your violation of these Terms; or (c) your infringement of any rights of a third party.

12. Force Majeure

We will not be responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, severe weather, public health emergencies, labour disputes, war, terrorism, civil disturbances, internet outages, power failures, cyberattacks, or failures of hosting or cloud providers.

13. Governing Law and Jurisdiction

These Terms and any dispute arising from or relating to the Site will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules.

You agree that any legal proceedings will be brought in the courts located in Toronto, Ontario, Canada, and you consent to the personal jurisdiction of those courts, subject to any non-waivable consumer protection rights that may apply in your place of residence.

14. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms or if your use creates security or operational risk.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and other provisions that by their nature should survive termination will survive any termination of these Terms.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and will not affect the validity and enforceability of the remaining provisions.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other notices posted on the Site, constitute the entire agreement between you and StoryGroup Canada Learning Inc. regarding your use of the Site and supersede any prior or contemporaneous understandings on that subject.

17. Assignment

We may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law. You may not assign these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any provision of these Terms will not be considered a waiver of our right to enforce that provision. Any waiver must be in writing and signed by us.

19. Changes to These Terms

We may update these Terms from time to time. Changes will be effective 14 days after the updated Terms are posted on the Site, unless a change is required by law or is effective immediately for security reasons. The “Last Updated” date at the top of this page indicates when these Terms were most recently revised.

20. Electronic Communications

You consent to receiving communications from us electronically. We may communicate with you by email or by posting notices on the Site. You agree that such communications satisfy any legal requirement that communications be in writing.
